Under California Proposition 36 a person charged with simple possession and with no crime of violence may be able to receive probation and drug treatment and their charges will be dismissed when their treatment is complete. There are several different treatment and rehab programs available that may take up to 12 months to complete followed with 6 months of aftercare. Prop 36 treatment programs are not available as an option if you have a prior felony conviction. Other options include:
- Drug Court - available in some counties that provide closely controlled supervision over both misdemeanor and felony drug offenders
- Diversion - after the defendant pleads guilty, they are sent by the court to attend drug education classes and are subject to random testing. If the terms are violated the court will follow through on sentencing.
