Defense for Marijuana Offenses
Marijuana, also called weed, pot or cannabis, is the most widely used illegal drug in the United States. As a result of this, marijuana offenses are extremely common, and many pot related crimes, especially those that involve larger quantities of the drug, are heavily prosecuted. Police, prosecutors and judges in this state are intolerant about drug crimes, and strive to make an example of those who have committed them by pursuing heavy sentencing options, prison time, high fines, mandatory drug counseling and rehabilitation.
The Los Angeles drug crimes attorneys from Takakjian & Sitkoff are committed to fighting your marijuana crime charges and providing the aggressive defense you need to counter the zealousness of the prosecution.
Penalties and Sentencing for Marijuana Related Crimes
Though this state has some of the most liberal laws in the U.S. regarding possession of marijuana, at this moment it is still considered to be an illegal substance. As of January 1, 2011 the possession of one ounce or less of marijuana will be considered to be an infraction, similar to a speeding ticket, with no criminal record and a maximum fine of $100.
You will not be arrested for possession of less than 28.5 grams if you agree to appear in court, and show I.D., and you will probably be given a citation for $100. If the possession is on school grounds, the sentence is a $500 fine and up to 10 days in jail. Over 28.5 grams has a penalty of up to 6 months in prison. Both of these crimes are misdemeanors.
Sale of marijuana is a much more serious offense with a sentence of 2-4 years in state prison, or 3-5 years if the drug is sold to a minor. Your driver's license may also be suspended.
Police often will often charge those who possess small amounts of marijuana with intent to sell, making it vital for you to hire a legal team who can poke holes in the prosecution's case and know the tough questions to ask. We are all former deputy district attorneys, and are fully committed obtaining justice for you so these charges will not adversely impact your future in any way.
